Using PocketSe

1. Acceptance of Terms

These Terms and Conditions ("Terms") form a legally binding agreement between you ("User") and PocketSe LLP ("PocketSe", "we", "us", or "our"). By creating an account, accessing the platform, or using any part of our service, you confirm that you have read, understood, and agree to these Terms.

If the user is under 18 years of age, a parent or legal guardian must review and accept these Terms on their behalf. Use of the platform by a minor without such consent is not permitted.

2. What PocketSe Is

PocketSe is a behavioural development platform that uses an AI-based Behavioural Reasoning Model (BRM) to help young people build habits, improve decision-making, and develop self-discipline. The platform collects behavioural data over time to generate individual profiles, predictions, and personalised interventions.

PocketSe is not a medical or psychological assessment tool. It does not diagnose, treat, or prescribe for any mental or physical health condition. If you have concerns about a child’s mental health or development, consult a qualified professional.

3. Eligibility

•        Individual users: 10 to 18 years of age, with verifiable parental or guardian consent

•        Parents and guardians: 18 years or older

•        Institutional users (schools, colleges): must be registered entities in India with an authorised signatory

Accounts created in violation of these eligibility criteria may be suspended or terminated without notice.

4. Accounts and Access

4.1 Account Creation

You are responsible for providing accurate and complete information during registration. PocketSe reserves the right to verify the information provided and to suspend accounts where inaccurate or misleading information is detected.

4.2 Credentials

You are responsible for maintaining the confidentiality of your login credentials. Do not share your password with anyone. Notify us immediately at legal@pocketse.in if you suspect unauthorised access to your account.

4.3 One Account Per User

Each student may hold one account. Creating multiple accounts to circumvent restrictions or earn additional rewards is a breach of these Terms.

5. Acceptable Use

You agree not to:

•        Use the platform in a way that violates any applicable Indian law or regulation

•        Attempt to reverse-engineer, decompile, or extract the source code or AI model underlying the platform

•        Submit false or misleading behavioural data to manipulate the model’s outputs

•        Use automated tools, bots, or scripts to interact with the platform

•        Harass, impersonate, or harm other users

•        Attempt to access another user’s account or data

•        Upload or transmit malware, viruses, or any malicious code

Violation of this section may result in immediate account suspension, termination, and where applicable, reporting to law enforcement.

6. Intellectual Property

All content, software, AI models, algorithms, data structures, brand assets, and design elements on the PocketSe platform are owned by or licensed to PocketSe LLP. Nothing in these Terms grants you any ownership right in the platform or its underlying technology.

You retain ownership of personal information you provide. By using the platform, you grant PocketSe a limited, non-exclusive, royalty-free licence to process your data as described in our Privacy Policy.

7. The Behavioural Model — What It Can and Cannot Do

PocketSe’s AI model generates behavioural profiles, predictions, and intervention suggestions. These outputs are informational and supportive in nature. They are not:

•        A substitute for parental judgment or professional advice

•        A guarantee of any developmental outcome

•        A clinical or psychological assessment

Predictions may be inaccurate. Interventions may not work for every individual. PocketSe does not warrant any specific outcome from use of the platform.

8. Subscriptions and Payments

Certain features of PocketSe may be offered on a paid subscription basis. Where applicable:

•        Subscription fees are charged in Indian Rupees (INR) unless otherwise stated

•        Fees are non-refundable except where required by applicable Indian consumer protection law

•        PocketSe reserves the right to change pricing with 30 days’ prior notice

•        Continued use of a paid feature after a pricing change constitutes acceptance of the new price

9. Disclaimers

The platform is provided “as is” and “as available”. PocketSe makes no warranty that:

•        The platform will be uninterrupted, error-free, or free of harmful components

•        Behavioural predictions will be accurate or suitable for any particular purpose

•        The platform will meet your specific expectations or requirements

10. Limitation of Liability

To the maximum extent permitted by Indian law, PocketSe LLP, its partners, directors, employees, and agents will not be liable for:

•        Indirect, incidental, or consequential damages arising from use of the platform

•        Loss of data, loss of revenue, or loss of opportunity

•        Decisions made by parents, guardians, teachers, or institutions based on the platform’s outputs

PocketSe’s total liability in any dispute shall not exceed the amount paid by you for the service in the three months preceding the event giving rise to the claim.

11. Termination

PocketSe reserves the right to suspend or terminate your account at any time for:

•        Breach of these Terms

•        Non-payment of fees (for paid accounts)

•        Legal or regulatory requirements

•        Extended inactivity (accounts inactive for more than 24 months)

You may terminate your account at any time by contacting us at legal@pocketse.in. Upon termination, your data will be handled in accordance with our Privacy Policy.

12. Modifications to the Service

PocketSe may add, modify, or discontinue features at any time. We will make reasonable efforts to notify users of material changes via in-app notifications or email. Continued use of the platform after such notice constitutes acceptance of the change.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Any dispute arising from these Terms will first be referred to mediation. If unresolved, disputes will be subject to the exclusive jurisdiction of the courts of [INSERT CITY], India.
